1. Introduction

Welcome to Discover Canada. These Terms of Service ("Terms") govern your access to and use of the Discover Canada website, located at dymnaya-zubatka.com, and all related services (collectively, the "Services"). Please read these Terms carefully before using our Services.

3. User Accounts

Some features of our Services may require you to create an account. When you create an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • Maintain and promptly update your account information

  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.

4. Bookings and Payments

4.1 Booking Process

When you make a booking through our Services, you agree to provide accurate and complete information for all travelers included in the booking. Certain travel services may have specific requirements (such as passport validity, visa requirements, health conditions), and it is your responsibility to ensure that you and your travel companions meet these requirements.

4.2 Pricing and Payment

All prices displayed on our website are in Canadian Dollars (CAD) unless otherwise specified. Prices may change without notice before a booking is confirmed. Your booking is not confirmed until you receive a booking confirmation from us and full payment has been received.

Payment methods accepted include major credit cards, debit cards, and bank transfers. For certain bookings, we may require a deposit at the time of booking, with the balance due by a specified date before the tour start date.

4.3 Taxes and Fees

Prices may not include all applicable taxes, fees, and charges. Any such additional amounts will be clearly disclosed before you complete your booking. You are responsible for paying all taxes, fees, and charges associated with your booking.

4.4 Third-Party Providers

Some services offered through our website may be provided by third-party suppliers (such as hotels, transportation companies, activity providers). When you book these services, you may also be subject to the terms and conditions of these third-party providers.

5. Cancellations and Refunds

5.1 Cancellation by You

Cancellation policies vary depending on the type of service booked. Specific cancellation terms will be provided during the booking process and in your booking confirmation. In general:

  • Cancellations made 60 or more days before the start date may receive a full refund minus an administrative fee
  • Cancellations made 30-59 days before the start date may receive a 50% refund
  • Cancellations made less than 30 days before the start date are typically non-refundable

All cancellation requests must be submitted in writing to our customer service team.

5.2 Cancellation by Us

We reserve the right to cancel any booking due to circumstances beyond our control (such as natural disasters, health emergencies, insufficient participation for group tours), or if you fail to make payments by the due dates. If we cancel your booking, you will receive either:

  • A full refund of all amounts paid to us
  • The option to transfer your booking to an alternative date or tour of similar value

5.3 Changes to Bookings

If you need to make changes to your booking, please contact us as soon as possible. Changes may be subject to availability and may incur additional fees. We cannot guarantee that all change requests can be accommodated.

5.4 Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance that includes coverage for trip cancellation, medical emergencies, and baggage loss/damage. Travel insurance is not included in our tour prices unless explicitly stated.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Discover Canada or our content suppliers and is protected by Canadian and international copyright laws.

You may access, view, download, and print content from our website for your personal, non-commercial use only. You may not:

  • Modify, copy, reproduce, republish, upload, post, transmit, or distribute any content from our website
  • Use any content for commercial purposes without our express written consent
  • Remove any copyright, trademark, or other proprietary notices from our content
  • Transfer the content to another person or "mirror" the content on any other server

The Discover Canada name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Discover Canada or our affiliates. You may not use these marks without our prior written permission.

7. User Responsibilities

7.1 Prohibited Activities

When using our Services, you agree not to:

  • Violate any applicable law, regulation, or these Terms
  • Use our Services for any illegal purpose
  • Attempt to gain unauthorized access to any part of our Services
  • Interfere with the proper operation of our Services
  • Use any automated means to access or use our Services
  • Introduce any viruses, trojans, worms, or other harmful material
  • Collect or harvest any information about other users
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity

7.2 User Content

If you submit any content to our website (such as reviews, comments, or forum posts), you retain ownership of your content, but you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

To the maximum extent permitted by law, Discover Canada and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use our Services
  • Any conduct or content of any third party on our Services
  • Any content obtained from our Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the greater of the amount paid by you to Discover Canada during the six-month period prior to such claim or $100 CAD.

The limitations of liability in this section do not apply to liability that cannot be excluded or limited by applicable law, such as liability for fraud or for death or personal injury caused by negligence.

9. Indemnification

You agree to defend, indemnify, and hold harmless Discover Canada and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services.

10. Governing Law

These Terms and any dispute arising out of or related to these Terms or our Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal action or proceeding relating to these Terms or our Services shall be instituted exclusively in the courts of the Province of Ontario. You and Discover Canada consent to the jurisdiction of such courts and waive any objection relating to the venue of such courts.

11. Changes and Termination

11.1 Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of our Services thereafter. Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes.

11.2 Changes to Services

We reserve the right to modify, suspend, or discontinue our Services (or any part thereof) at any time and without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of our Services.

11.3 Termination

We may terminate or suspend your access to all or part of our Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of our Services, us, or third parties, or for any other reason.
